Hi Rob,
thank you for the clarifications.
The message by Gordon Scott says that
If you are absent on any of the days outlined below for a reason that is not related to the strike, then please notify your Head of Department / School or Director in accordance with standard University procedures. Annual leave will not normally be agreed at times that coincide with industrial action dates unless it has already been arranged with a Head of Department / School or Director.
Working from home as it was suggested in the message on 5 December 2022 did not require to notify the Head of the Department. Gordon Scott's message instead implies that with no notification to the Head of the Department, the absence will not be considered as related to strike or to an authorised annual leave. Hence breach of contract.
My question is then. If we work from home tomorrow, should we all notify the Head of the Department and obtain authorisation to comply with Gordon Scott's message? This was not specified in the message of 5 December 2022.

Dear Gian-Luca,

I'm writing as Deputy Head as I'm not sure that Stefan will be in a position to respond.

Gabrielle's message was sent yesterday using the best available information at that time and I think we go with the arrangements proposed in it - work from home if that is possible and if you need to come into the building to work then follow the red card arrangements and contact John Gillan.

I didn't see anything specific in Gordon's message about breach of contract for working from home tomorrow. If I missed it please could you highlight it and I'll check whether I need to change my message.

Dear Gabrielle,
your message yesterday very sensibly said:
"No University buildings will be closed on this occasion, however, due to the lack of fire marshalls and first aiders who would be available in the John Anderson building, staff based in the JA building are asked to work from home that day" (7th December 2022, i.e. tomorrow).
But today we got a contradictory message from Gordon Scott saying that only personnel in the closed building are authorised to work from home.
And the John Anderson building is not in the list of closed building (while strategically the McCance building where HR resides is).
The concern is that there will be no security guaranteed for normal day operation in the John Anderson building.
Is anyone of our Department working from home tomorrow considered in breach of contract as threatened by Mr. Scott in his message?
Is anyone entering the John Anderson building supposed to contact John Gillan first as suggested in the message below?

Dear all,

As you know, UNITE has called a strike on Wednesday 7th December, so most University security staff will be on strike.

No University buildings will be closed on this occasion, however, due to the lack of fire marshalls and first aiders who would be available in the John Anderson building, staff based in the JA building are asked to work from home that day.

We will operate the weekend working system, so anyone with red card access can work in the building if they really need to.  If you are going to be working on campus, please inform John Gillan beforehand so that he can inform security of the names and locations of those who will be in the building.

Arrangements for Thursday 15th December (the next UNITE strike day) will be slightly different as we have some exams on that day, so some staff will be in the JA building for invigilation, exams admin, parcel delivery etc.   However, most staff will be asked to work from home on the 15th if they can.

Physics staff in TIC are also advised to work from home if possible, but IOP staff may also receive specific instructions from Jennifer Hastie.
